  • Cauffman Drain Landowner Hal Huffman discussion. County Road 800 South and 200 West.
  • The Board discussed the drainage issue on Hal Huffman's property.  Cary Groininger would like to see a list of all the work that needs done on this drain so the Board can prioritize the repairs. Also Kissinger indormed the Board that both of the Cauffman Tif projects and the Plunge Creek Reconstruction are completed.
  • Vandermark Drain: Discuss the future of the drain and abandonment.
  • After some discussion the Board tabled this issue until after January in order to discuss it with the Drainage Board Attorney.
  • Mike Hall will be present to discuss our County insurance.
  • MR. HALL WAS INVITED TO THE MEETING TO DISCUSS WHETHER WORKMANS
    COMPENSATION INSURANCE IS REQUIRED FOR THE CONTRACTORS THAT THE
    DRAINAGE BOARD HIRES. IF THE CONTRACTOR IS A CORPORATION THEY ARE REQUIRED
    TO HAVE WORKMANS COMP ON THEIR CERTIFICATE OF LIABILITY INSURANCE FORM. IF
    THEY ARE NOT A CORPORATION OR A LIMITED LIABILITY CORP THEY CAN FILE WITH THE
    STATE OF INDIANA FOR AN APPLICATION FOR WORKERS COMPENSATION CLEARANCE
    CERTIFICATE. BY LAW, CONTRACTORS ARE REQUIRED TO HAVE EITHER WORKMANS
    COMPENSATION ON THEIR CERTIFICATE OF LIABILITY OR THE AFFIDAVIT FROM THE
    STATE OF INDIANA FOR COMPENSATION CLEARANCE. BEGINNING JANUARY 1, 2020,
    THE DRAINAGE BOARD WILL BE REQUIRING ALL CONTRACTORS THAT WISH TO WORK
    FOR THE COUNTY TO CARRY WORKMANS COMPENSATION INSURANCE OR HAVE THE
    AFFIDAVIT FROM THE STATE FOR THE CLEARANCE CERTIFICATE. MINIMUM FOR EACH OCCURRENCE WILL BE REQUIRED TO BE $1,000,000.00 GENERAL
    LIABILITY AND THE WORKMANS COMPENSATION IS REQUIRED TO BE $500,000.00,
    $500,000.00, AND $500,000.00.
    BEGINNING JANUARY 1, 2020 ALL CONTRACTORS WILL BE REQUIRED TO HAVE THEIR
    CERTIFICATE OF LIABILITY INSURANCE FORM ON FILE IN THE SURVEYORS OFFICE WITH
    THE KOSCIUSKO COUNTY BOARD OF COMMISSIONERS AS ADDITIONALLY INSURED AND
    THE ADDITIONALLY INSURED BOX CHECKED ON THE FORM.
    THERE WAS DISCUSSION ABOUT A CURRENT RECONSTRUCTION CONTRACT WITH A
    CONTRACTOR THAT DOES NOT CURRENTLY CARRY WORKMANS COMP. THIS
    CONTRACTOR WILL NEED TO PROVIDE PROOF OF WORKMANS COMP INSURANCE ON
    OR BEFORE JANUARY 1, 2020.
    JIM SCOTT MADE A MOTION FOR A LETTER TO BE DRAFTED TO INFORM THE
    CONTRACTORS OF THE UPCOMING CHANGES. ALL CERTIFICATE OF LIABILITY WITH
    WORKMANS COMP OR THE STATE CLEARANCE CERTIFICATE (ANNUALLY UPDATED
    CERTIFICATE) WILL NEED TO BE KEPT UP TO DATE WITH THE OFFICE. THEY NEED TO
    HAVE ALL THE PROPER DOCUMENTS IN THE SURVEYORS OFFICE BEFORE JANUARY 1,
    2020 TO RECEIVE ANY COUNTY DRAINAGE WORK. JOE IRWIN SECONDED THE MOTION
    AND ALL WERE IN FAVOR.
  • Lex Dalton will be present to discuss ditch spraying.
  • LEX DALTON FROM ~THE DALTON’S~ CAME BEFORE THE BOARD TO SPEAK OF THE
    ANNUAL SPRAYING PROGRAM AND TO ANSWER ANY QUESTIONS THEY MAY HAVE FOR
    WEED AND BRUSH CONTROL FOR THE COUNTY DRAINS. DALTON INFORMED THE
    BOARD THAT HIS COMPANY CHARGES BY THE GALLON (FURNISHED AND APPLIED) NOT
    BY THE LENGTH OF THE DITCH BEING SPRAYED.
  • James Welch Drain: Reconstruction discussion.
  • THE JAMES WELCH RECONSTRUCTION WAS TABLED UNTIL THE DECEMBER MEETING.
  • Silveus Reconstruction Contract
  • The Board signed the contract with Wertenberger Tiling and Excavating for the Silveus Reconstruction.
